1. Agreement to Terms
By downloading, installing, or using the Market App ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
We reserve the right to modify these Terms at any time. Your continued use constitutes acceptance of modified Terms.
2. User Accounts
2.1 Account Creation
To use the App, you must create an account with a valid email address, a strong password, and accurate personal information.
2.2 Your Responsibility
You are responsible for:
- Maintaining password confidentiality
- All activities under your account
- Notifying us of unauthorized access
- Complying with all applicable laws
2.3 Account Termination
We may terminate your account if you violate these Terms, engage in fraud or illegal activity, abuse other users, or post prohibited content.
3. Prohibited Conduct
You agree NOT to:
Illegal Activities
- Buy/sell illegal items
- Engage in money laundering
- Violate local laws
Fraud & Deception
- Misrepresent products or prices
- Use false information
- Conduct scams
Harassment & Abuse
- Harass or threaten users
- Send spam
- Impersonate others
Prohibited Items
- Weapons, explosives, drugs
- Stolen or counterfeit goods
- Adult content
- Hazardous materials
Technical Abuse
- Attempt to hack or reverse engineer
- Introduce viruses
- Interfere with server operations
- Scrape data
4. Marketplace Conduct
4.1 Seller Obligations
- ✓ Provide accurate product descriptions
- ✓ Use genuine photos/videos
- ✓ Respond to inquiries within 24 hours
- ✓ Honor stated prices
- ✓ Ship items as promised
- ✓ Refund for non-delivered items
4.2 Buyer Obligations
- ✓ Pay agreed-upon prices
- ✓ Communicate respectfully
- ✓ Report issues promptly
- ✓ Provide honest ratings
4.3 Dispute Resolution
- Contact the other party first
- Report disputes within 14 days of transaction
- We may arbitrate in good faith
- Our decisions are final and binding
5. Payments & Fees
5.1 Payment Processing
Payments are processed through Stripe. We DO NOT store your credit card information.
5.2 Fees
- Listing creation: FREE
- Transaction fees: Based on payment method (typically 2.9% + $0.30)
- Premium features: Displayed before purchase
5.3 Taxes
You are responsible for sales tax on items sold, income tax on earnings, and any local business licenses.
6. Intellectual Property
6.1 Our IP
The App, including logo, design, code, text, and graphics are our property protected by copyright and trademark laws.
6.2 Your License
We grant you a limited, non-exclusive license to use the App for personal, non-commercial purposes.
6.3 Restrictions
You may not copy, modify, or distribute the App; reverse engineer or decompile; create derivative works; or use it for commercial purposes without permission.
7. Limitation of Liability
7.1 Disclaimer
The App is provided "AS IS" without warranties of merchantability, fitness for a particular purpose, or uninterrupted service.
7.2 Liability Limits
We are NOT liable for lost profits or revenue, loss of data, indirect or consequential damages, or damages exceeding what you paid us.
7.3 Your Risk
You acknowledge that marketplace transactions involve risk. We're not responsible for buyer/seller trustworthiness, lost or damaged items, or product quality.
8. Privacy
Your use of the App is governed by our Privacy Policy. Please review it to understand our data practices.
9. Third-Party Services
The App uses these third-party services with their own terms:
- Google Firebase: Database and storage
- Google Mobile Ads SDK: Advertising
- Stripe: Payment processing
- Google Play Services: Notifications and analytics
We're not responsible for their services or policies.
10. Dispute Resolution
10.1 Informal Resolution
Before legal action, both parties agree to attempt informal resolution, provide written notice of dispute, and allow 30 days for resolution.
10.2 Arbitration
If not resolved, disputes will be settled by binding arbitration conducted by a neutral arbitrator. Costs are split equally.
10.3 Exceptions
Arbitration doesn't apply to small claims court (if available), intellectual property violations, or emergency injunctive relief.
11. Governing Law
These Terms are governed by the laws of the United States, without regard to conflicts of law principles.
