Welcome to Que'd. These Terms of Service ("Terms") govern your use of the Que'd mobile application ("App") developed and operated by Nimbusa ("we", "our", "us"). By downloading, installing, or using the App, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use Que'd. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Account
- You may create an account using Apple Sign-In or as a guest.
- You are responsible for maintaining the security of your account.
- You agree to provide accurate information for your display name and profile.
- We reserve the right to suspend or terminate accounts that violate these Terms.
3. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Upload offensive, abusive, or inappropriate content (including profile photos and display names).
- Harass, bully, or threaten other players.
- Cheat, exploit bugs, or use automated tools to gain an unfair advantage.
- Attempt to access other users' accounts or data.
- Interfere with the operation of the App or its servers.
- Create multiple accounts to manipulate leaderboards or abuse the Pay It Forward feature.
4. Games and Points
- Points are earned by playing games within the App. Points have no monetary value and cannot be exchanged for cash.
- Leaderboard rankings are based on accumulated points and are provided for entertainment purposes.
- We reserve the right to adjust point values, reset leaderboards, or modify the scoring system at any time.
5. Pay It Forward
- The Pay It Forward feature allows you to purchase a treat (drink, snack, or meal) for another player at a participating venue.
- All payments are processed by Stripe and are subject to Stripe's terms of service.
- Treats expire 24 hours after purchase if unclaimed. Expired treats may be refunded at our discretion.
- We are not responsible for the quality, availability, or redemption of treats at any venue. The Pay It Forward feature is a gesture of goodwill between players.
- All purchases are final. Refund requests may be submitted to nimbusadev@gmail.com and will be reviewed on a case-by-case basis.
6. Advertisements
The App displays advertisements served by Google AdMob. Free users may see banner ads, interstitial ads between games, and optional rewarded ads. Ad content is determined by Google and is not controlled by us. You may report inappropriate ads to nimbusadev@gmail.com.
7. User Content
- You retain ownership of photos you upload (profile photos and winner selfies).
- By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to display that content within the App for its intended purpose (e.g., showing your profile photo to other players).
- We may remove any content that violates these Terms without notice.
8. Intellectual Property
The App, including its design, code, graphics, and game mechanics, is owned by Nimbusa and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.
9. Location Services
Certain features require location access to find nearby players. Location data is used only for in-app functionality (matchmaking, leaderboards) and is not sold to third parties. You can disable location access in your device settings at any time, though some features may not function without it.
10. Disclaimers
- The App is provided "as is" without warranties of any kind, express or implied.
- We do not guarantee uninterrupted or error-free operation.
- We are not responsible for interactions between players, including in-person meetups that may result from using the App's nearby player features.
- We are not liable for any loss of data, points, or game progress.
11. Limitation of Liability
To the maximum extent permitted by law, Nimbusa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim related to the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50, whichever is greater.
12. Account Deletion
You may delete your account at any time from the Settings screen in the App. Upon deletion, your personal data will be removed within 30 days. Some anonymized data (e.g., aggregated leaderboard statistics) may be retained.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the App. Continued use after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you should stop using the App and delete your account.
14. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the applicable jurisdiction.
