Welcome to Treasure This! These Terms of Service ("Terms") govern your use of the Treasure This! mobile application ("App") developed and operated by Nimbusa ("we", "our", "us"). By downloading, installing, or using the App, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Treasure This!. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account

• You may create an account using Apple Sign-In or with an email address and password.
• You are responsible for maintaining the security of your account.
• You agree to provide accurate information for your display name and profile.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Upload offensive, abusive, or inappropriate content (including treasure descriptions, clues, photos, and display names).
• Harass, bully, or threaten other users.
• Create treasures in dangerous, restricted, or private locations without authorization.
• Place physical objects that could be harmful, illegal, or hazardous as treasure items.
• Cheat, exploit bugs, or use automated tools to gain an unfair advantage.
• Attempt to access other users' accounts or data.
• Interfere with the operation of the App or its servers.
• Create multiple accounts to manipulate statistics or rankings.

4. Treasure Hunts and Physical Safety

• Treasure This! involves real-world exploration. You are solely responsible for your own safety while participating in treasure hunts.
• Always be aware of your surroundings, obey local laws, and respect private property.
• Do not trespass, enter restricted areas, or put yourself in dangerous situations to find or hide treasures.
• We are not responsible for any injury, loss, or damage that occurs while using the App or participating in treasure hunts.
• Parents and guardians are responsible for supervising minors during treasure hunts.

5. XP and Levels

• Experience points (XP) and explorer levels are earned by finding and hiding treasures. They have no monetary value and cannot be exchanged for cash.
• We reserve the right to adjust XP values, levels, or the progression system at any time.

6. User Content

• You retain ownership of photos, treasure descriptions, and clues you create.
• By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to display that content within the App for its intended purpose (e.g., showing treasure photos and clues to other users).
• We may remove any content that violates these Terms without notice.

7. Intellectual Property

The App, including its design, code, graphics, and game mechanics, is owned by Nimbusa and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.

8. Location Services

Core features of the App require location access to display nearby treasures and guide you during hunts. Location data is used only for in-app functionality and is not sold to third parties. You can disable location access in your device settings at any time, though treasure hunting features will not function without it.

9. Disclaimers

• The App is provided "as is" without warranties of any kind, express or implied.
• We do not guarantee uninterrupted or error-free operation.
• We do not verify the existence, safety, or accessibility of user-created treasures.
• We are not responsible for interactions between users or any real-world consequences of treasure hunts.
• We are not liable for any loss of data, progress, or game content.

10. Limitation of Liability

To the maximum extent permitted by law, Nimbusa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to physical injury, property damage, or loss incurred during treasure hunts. Our total liability for any claim related to the App shall not exceed $50.

11. Account Deletion

You may delete your account at any time from the Settings screen in the App. Upon deletion, your personal data will be removed within 30 days. Treasures you created may be retained in anonymized form to preserve other users' find history.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes through the App. Continued use after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you should stop using the App and delete your account.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the applicable jurisdiction.
