Terms of Service

Welcome to Mailbox. These Terms of Service ("Terms") govern your use of the Mailbox mobile application ("App") developed and operated by Nimbusa ("we", "our", "us"). By downloading, installing, or using the App, you agree to these Terms. If you use Mailbox as a delivery driver, the separate Driver Agreement also applies to you.
1. Eligibility
You must be at least 18 years old to use Mailbox. By using the App, you represent that you meet this requirement and that the information you provide is accurate.
2. What Mailbox Is
- Mailbox is a marketplace that connects clients who need a package delivered with independent drivers who perform the delivery.
- We do not employ drivers and do not ourselves transport, handle, or deliver packages. Drivers are independent contractors, not employees or agents of Nimbusa.
- We do not take ownership or custody of any package and are not a carrier, freight forwarder, or logistics provider.
3. Account
- You create an account using an email address and password and select a role (client or driver).
- You are responsible for maintaining the security of your account and for all activity that occurs under it.
- You agree to provide accurate information for your display name and profile.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Requesting a Delivery
- Clients request a delivery by dropping a location pin on the map and providing package details such as carrier, tracking number, and notes.
- You are responsible for the accuracy of the pin location, package details, and any access instructions you provide.
- You must have the legal right to receive the package and to direct its delivery to the location you choose.
- A delivery is offered to nearby available drivers; acceptance by a driver is not guaranteed.
5. Prohibited Items and Acceptable Use
You agree not to use Mailbox to arrange the delivery of, or to deliver, any item that is illegal, hazardous, perishable beyond safe transport, stolen, or otherwise prohibited by law or by common carrier policies. This includes weapons, controlled substances, hazardous materials, live animals, and cash or cash equivalents. You also agree not to:
- Use the App for any unlawful purpose.
- Post offensive, abusive, or inappropriate content (including messages, names, photos, and notes).
- Harass, threaten, or discriminate against other users.
- Create fake profiles or impersonate others.
- Commit payment fraud or use stolen payment methods.
- Manipulate ratings or reviews.
- Arrange deliveries or payment outside the App to avoid fees.
- Attempt to access other users' accounts or data, or interfere with the operation of the App or its servers.
6. Payments and Fees
- All payments are processed through Stripe and are subject to Stripe's terms of service. We never handle or store your full card details.
- The delivery fee is disclosed in the App before you confirm a request. Mailbox also offers an optional paid subscription, billed on a recurring basis; the price and billing interval are shown before you subscribe.
- Subscriptions renew automatically until cancelled. You can cancel at any time through the customer billing portal accessible from the App; cancellation takes effect at the end of the current billing period.
- If you cancel a delivery after a driver has been assigned, a cancellation fee may apply, and any refund will be reduced accordingly. Cancellation and refund rules are shown in the App at the time of cancellation.
- Refund requests may be submitted to nimbusadev@gmail.com and are reviewed on a case-by-case basis.
7. Ratings and Reviews
After a delivery, clients and drivers may rate and review each other. Reviews must be honest and must not contain abusive, defamatory, or inappropriate content. We may remove reviews that violate these Terms.
8. User Content
- You retain ownership of photos, messages, notes, reviews, and other content you create.
- By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to display and use that content within the App for its intended purpose.
- We may remove any content that violates these Terms without notice.
9. Intellectual Property
The App, including its design, code, graphics, and branding, is owned by Nimbusa and protected by copyright and intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.
10. Disclaimers
- The App is provided "as is" without warranties of any kind, express or implied.
- We do not guarantee uninterrupted or error-free operation, or that a driver will be available for any given request.
- We do not take custody of packages and do not guarantee the safe, timely, or successful delivery of any package.
- We are not responsible for the acts or omissions of drivers or clients, for lost, damaged, stolen, or misdelivered packages, or for any injury, property damage, or loss arising from a delivery arranged through the App.
11. Limitation of Liability
To the maximum extent permitted by law, Nimbusa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim related to the App shall not exceed the amount you paid in platform fees in the 12 months preceding the claim, or $100, whichever is greater.
12. Account Deletion
You may delete your account at any time — see our Delete Account page. Upon deletion, your personal data will be removed within 30 days. Payment and transaction records are retained for up to 7 years as required by law.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes through the App. Continued use after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you should stop using the App and delete your account.
14. Governing Law
These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).
